Snarky, after consulting with my legal council. I have been advised that your references to abuse and printing and distributing the allegations (ie “beating around the ring” ) of my ad for La Luz meet all the criteria for slander. If this is not removed I will proceed accordingly as well as notify all other victims of your verbal ABUSE of their legal rights regarding your vicious publication. You can mock my riding but abuse referernces are absolutely unfounded!
Hi Denise, I did not reference abuse in the post nor did I allege that you beat your horse. What I was implying was that the trainer, a presumably paid professional, was at fault for not counseling her student (apparently you) that the horse would appear off in the video, thus making it an unsuitable sales video (I would also hope that the trainer would advise her student to have the horse checked by a vet or a chiropractor at least). I’d also like to point out that at no point did I mock your riding. Someone who is obviously taking lessons and working to improve their skills doesn’t deserve to be mocked because their not yet at a certain level. You obviously feel that this post was attacking you and for that I am sorry, but because it doesn’t include any of the offenses you specified, I will not be removing it. If you’d like to discuss this further, please feel free to email me at snarkyriderblog@gmail.com.
On another note, if you had in fact consulted legal counsel (a “council” is completely different), they would have spoken of libel, not slander. They likely would have mentioned that a blog, by nature, cannot be VERBALLY abusive. My “publication” isn’t vicious but it does strive to stand up for the well-being of horses.
PS. Posting a comment on the post in question is more effective than a random page on the blog – for future reference.
“Beating the horse around the ring” certainly sounds like you accusations of abuse to me! In court it may be interpreted as defamation as well. What ever mission you feel you are on!
amatuers with your vocious comm
ooooooh I just got that you’re referring to the title of the post. It’s actually “4 beating around the arena we go” in reference to the way the pony is moving. It has absolutely nothing to do with abuse or any accusations thereof.
Both slander and libel fall under defamation. Ie. if something is slanderous it can’t be defamatory as well since it already, technically, is defamation. < -None of which occurred here. I’m sorry you misread the title of the post.
Ooo. Drama.
Snarky,
Ms. Flouncy La Luz’s inability to comprehend that “4-beating around the arena” is a reference to the pony’s incorrect canter gait is indicative of the level of her equestrian training.
I work in dispute mediation. The general rule is that those with the weakest, non-credible cases are the ones who loudly and vociferously threaten to sue, call their congressperson, hold their breath until they die, etcetera -but all they do is just threaten, because that is all that they can do.
Those with strong, valid cases calmly and quietly retain an attorney or file a congressional inquiry. Those with strong, valid cases have no need to bluster or use emotional language, as the facts of their case speak for themselves.
Helen Killer at Regretsy blog has written quite extensively on this topic.
Common sense would dictate that after one places a sale ad on the internet, one loses any expectation of privacy.
Warm Regards,
